Terms and Conditions

This document, containing the terms and conditions of use of the website www.migrantcenter.ro (hereinafter referred to as the “Terms and Conditions”), establishes the conditions under which any person may visit or access the website www.migrantcenter.ro, or may use in any way the services offered through the website.

For the purposes of these Terms and Conditions: “Site” shall mean the website www.migrantcenter.ro; “Site Administrator” shall mean Migrant Center, headquartered in Bucharest; “Service” shall mean any service offered on the Site, and/or any module or component thereof; “User” shall mean any person who visits or accesses the Site, who wishes to use in any way, or actually uses, the Service.

Failure to accept these Terms and Conditions, or any provision thereof, as formulated in this document, obliges the User to immediately cease accessing the Site; continued access or visitation of the Site, any page thereof, and/or the use of the Service, as well as any of its components, constitutes full and unconditional acceptance of the Terms and Conditions and any provision contained therein.

The content and graphic elements of the Site, including but not limited to all text content and any other materials transmitted in any form to and from Users (whether through direct viewing on the Site, newsletters, or any other materials directly or indirectly related to the Site) belong to the Site Administrator and its partners and constitute the Site’s content. By exception to the previous provision, materials for which a different rights holder, owner, or source is indicated on the Site, as well as any opinions and/or comments of any kind expressed by Site Users regarding any materials posted on the Site or the Site Content in general, do not belong to the Site Administrator or its partners.

In cases where the Site Content, regardless of its section or type, is sourced by the Site Administrator from other content producers or issuers (in text, image, graphic, video sequences, or other formats), such sourcing is carried out in compliance with applicable laws and rules.

Users understand and agree that the Site Administrator is exempt from any liability regarding materials, data, and information, including but not limited to those sourced from any official channels, such as press releases. Users understand and agree that all information, data, and materials posted on the Site are solely for informational purposes and that the Site Administrator cannot be held liable in any way for the accuracy or validity of the Site Content or for any legal consequences arising from its use.

Users are obliged to respect all copyright and related rights, as well as any other intellectual property rights held by the Site Administrator and its partners over or in connection with the Site, its Content, the Service, any module or component thereof, or its use. Users understand and agree that any violation of the above provisions may result in liability toward the authors/owners of the Site Content.

Site Content, regardless of its section or type, may only be used for personal purposes, defined herein as purely non-commercial purposes, without any direct or indirect intention of deriving profit or gain from such use. Any use of the content by third parties for purposes other than personal use requires the express prior written consent of the Site Administrator.

Copying, extracting, reproducing, publishing, transmitting, selling, distributing, in whole or in part, or modifying the content of this Site for any purposes other than personal use is prohibited; the Site Administrator reserves the right to take legal action against any person or entity violating these provisions.

Requests for using Site content for purposes other than personal use may be sent by email to office@migrantcenter.ro, with the note “For the Migrant Center Team,” or through any of the methods indicated on the Site’s Contact page.

Any person sending information or materials to the Site undertakes not to infringe on any copyright that a third party may claim regarding such materials and understands that any violation of this obligation does not engage the liability of the Site Administrator, but solely of the respective sender.

Users submitting information or materials to the Site agree to exclusively transfer, on an unlimited term and worldwide, all rights to use, adapt, modify, and/or retransmit the content they contribute or post to the Site. The Site Administrator cannot be held responsible for any damages caused by content posted on the Site by any person, regardless of the section, service, or feature to which such content belongs.

Posting on the Site of any content, including materials, comments, images, video sequences, but not limited to these, containing obscene or vulgar language, illegal, threatening, abusive, indecent texts, racist or chauvinistic messages, or content that could discriminate against any person in any way, or violate any other human rights under applicable law, is strictly prohibited.

Users understand and agree that, in case of any violation of the Terms and Conditions, the Site Administrator may, at its sole discretion, suspend the User’s access to any Site Service entirely or partially, refuse publication of any User-submitted content, modify such content in any way, permanently block access to one or more Site features, or terminate the User’s account, without any prior warning, notice, or formalities.

Users understand and agree that the Site provides only a communication platform and that they alone are responsible for any materials, data, and information posted on the Site, regardless of the format or section (e.g., blog, avatar, comments, etc.), and for any legal or commercial consequences arising therefrom.

According to the requirements of Law no. 677/2001 on the protection of individuals regarding the processing of personal data and the free movement of such data, as amended, and Law no. 506/2004 on the processing of personal data and the protection of privacy in the electronic communications sector, the Site Administrator will manage personal data provided by Users in secure conditions and only for the specified purposes.

We inform you that the personal data Users provide to the Site Administrator is processed for the purpose of optimally providing the Service. Users understand and accept that the personal data they provide is processed to allow the Site Administrator to optimally offer internet services, advertising, marketing and publicity services, statistical analysis, and/or the provision of goods and services.

The storage of information or access to information stored on the User’s terminal equipment is carried out by the Site Administrator only for the following purposes: provision of internet services, marketing, advertising, and/or the provision of goods and services. Third parties who store information or have access to the information stored on the terminal equipment of the User of www.migrantcenter.ro are: advertising providers, audience and site performance analytics service providers, and providers of goods and services.

According to Law no. 677/2001, each User has the right to access, intervene in their data, the right not to be subject to an individual decision, and the right to address the courts.

Additionally, the User has the right to object to the processing of personal data concerning them and to request the deletion of their data. Users understand and accept that deleting their personal data will result in the deletion of their account from the system and the impossibility of accessing the Service offered by the Site Administrator.

To exercise these rights, each User may submit a written request and send it by post or via email to the Site Administrator at: office@migrantcenter.ro.

Users understand and agree that the Site may contain links or references to other websites, including personal websites (blogs), websites of product and/or service providers to which advertising banners posted on the Site or advertising microsites redirect, but not limited to these, which are considered by the Site Administrator to be useful in connection with the Site’s Content, but which are not under its control or guidance.

The Site Administrator is released from any liability regarding the content or opinions expressed on all the aforementioned websites, as well as their accuracy and correctness, and Users understand and agree that these websites are not monitored, controlled, or verified in any way by the Site Administrator. The inclusion of a link or reference to other websites does not imply approval of them by the Site Administrator in any way.

When Users access these websites, they do so at their own risk, knowing that the use of services offered by these websites is subject to the terms established by the administrators of those websites.

The Site Administrator does not assume any obligation and does not provide any express or implied warranties regarding any content on the Site or the content provided by Users. The Site Administrator will make all reasonable efforts to ensure accuracy and reliability on the Site and will attempt to correct errors and omissions as quickly as possible.

The Site Administrator provides no warranties or liability for the Site Content and, under no circumstances, can be held responsible for any loss or damage resulting from the use of any part, sequence, or module of the Site Content, or from the inability to use it, regardless of the cause or any misinterpretation of the Site Content.

Users understand and agree that the provision of the Service may be affected by certain objective conditions, and that any services offered through the Site are provided on an “as is” and “as available” basis, and Users use these services at their own risk.

Consequently, the Site Administrator cannot be held liable for any information or data contained in the Site Content, including but not limited to text, images, video sequences, avatars, blogs, or any other activity related to use, nor for any legal effects deriving from them.

Users understand and agree that the Site Administrator is released from any liability in the event of any interruption, suspension, malfunction, or error in the operation of the Site, in the case of any technical error of any kind, or any errors in the provision of the Service, including situations where it cannot be proven that any of these errors or technical issues result directly and exclusively from the Site Administrator’s gross negligence.

Users expressly understand and agree that the Site Administrator is not liable for any direct or indirect damages, including but not limited to loss of profit, business goodwill, or other intangible losses resulting from the use of the Service, any aspect related to the Service, or the use of Site Content in any way, or any legal consequences arising from such use.

Users understand and agree that the Site Administrator is not liable for any advertising messages posted on the Site or through the Service, nor for the goods or services provided by the authors of such advertising messages.

In cases of force majeure, the Site Administrator and/or its operators, directors, employees, branches, subsidiaries, and representatives are fully exempt from liability. Force majeure includes, but is not limited to, technical equipment malfunctions of the Site Administrator, internet connection failures, telephone connection failures, computer viruses, any type of cyberattacks and interference by malicious software, unauthorized access to Site systems, operational errors, strikes, etc.

Users agree to fully protect, indemnify, and hold harmless the Site Administrator and/or its operators, directors, employees, branches, subsidiaries, and representatives from and against any claims, demands, actions, liabilities, losses, damages, costs (including, without limitation, attorney, expert, consultant, or enforcement fees), expenses, judgments, decisions, fines, settlements, or other obligations arising from or related to any action by the User in connection with the use of the Service or any other aspect related to the Service.

The rights and obligations of the Users and the Site Administrator, provided by the Terms and Conditions, as well as all legal effects produced by the Terms and Conditions, shall be interpreted and governed in accordance with the applicable Romanian law.
Any dispute arising from or in connection with the Terms and Conditions shall be resolved amicably.

In the event that an agreement cannot be reached, the dispute shall be resolved by the competent Romanian court within the territorial jurisdiction of the municipality of Bucharest.

The Site Administrator has the right to modify at any time and in any manner any of the provisions of the Terms and Conditions, or the Terms and Conditions in their entirety, without any prior notice and without being obliged to fulfill any other formality toward the Users.

Any modification will be considered fully and unconditionally accepted by any User through simple use or access of any facility offered by the Site or the Service, or through accessing the Site, occurring at any time after the modification, and the non-acceptance of any modification entails the obligation of that User to immediately cease accessing the Site and/or using the Service in any manner.
